Michael’s view of hospital debate...”It’s my agenda”

Editor's Note: Following is Part Two of an article that was published on Page One of the Friday, Sept. 25, issue of the Cibola Beacon.


CIBOLA COUNTY - The Cibola County Commission and the Cibola General Hospital Corporation are once again at odds. What started out several months ago as a small issue has turned into today's big verbal request from County Commission Chairman Eddie Michael for a statement from the CGHC board that the county is sole owner of the hospital.

    As of last week, the hospital board had no such plans to provide a statement.

The small issue was when Michael requested the hospital board to nominate one commissioner to its board. On the contrary, the board nominated ten people who are not commissioners, four of the ten already on the board. Five seats on the board were available. The four members stayed on the board and Walter Meech replaced Bob Ewell and ultimately left Michael unhappy.

    Michael said on Thursday, Sept. 24, that the hospital board's perceiving the issues in which the county commission has with the hospital board was not the agenda of new County Manager Scott Vinson. “They are not his (Vinson's) issues, the issues are my agenda,” Michael told the Beacon.

Last week, hospital board member and past president Lawrence Sanchez said that Vinson sold the Deming hospital to a Las Cruces hospital and now Deming has a “glorified clinic.”

    “Do they think I am stupid?” Michael said in regard to the hiring of Vinson. “I made a trip to Deming because I don't trust anyone. I reviewed the Luna County projects. I visited with the county chairman of Luna County. I saw the background in which Vinson left in Luna County.”

    According to Michael and Vinson, the Deming hospital has more doctors and services available to the public than CGH does and the communities are similar in size. “But that doesn't matter,” Vinson said, “The Deming hospital was a complete different situation than the Grants hospital. It was failing. Selling it was our (Luna County) best option. Cibola General Hospital is not failing and is well run. Our intent is not to sell. The issues here are all about accountability and transparency.”

    Hospital Board Member Sanchez said, “If you look back, the community has rallied for the hospital . . . some commissioners lost their seats because they tried to get involved (in the hospital).”

The hospital board told the Beacon last week that it is in the process of hiring new doctors and a new clinic is in the plans, “now everything is on hold because the commissioners have decided not to work with us,” board member Ida Chavez said.

    In the mid 1990s the hospital was financially challenged and the county became involved and purchased the hospital while CGHC operated it. In 2004, a new contract was created in which the hospital is to pay the county $260,000 a year in which, according to Michael, the fee has been waived the last few years in order for the board to focus on hiring new staff. The county agreed with CGHC to manage the hospital.

    The hospital relies on four county mill levies earning close to $800,000 per year. The hospital also relies on the county in pursuing state and federal grants, according to Vinson.

Hospital Board President Ann Mattila concluded the interview last week by stating, “My hope is we work collaboratively. If we have to battle with the county every time we turn around then we cannot pursue the long term goals.”

    According to Michael the big issue today is who owns the hospital. Hospital officials claim that the county owns the building and the hospital owns the operation. Michael said the county residents own the hospital.

    Vinson reiterated Michael's concern last week saying, “The taxpayer owns the hospital. The value of the hospital is the value of the business, the residents own that, the business.” Vinson concluded his interview by saying, “Eddie (Michael) wants the statement from the CGHC board because of hospital CEO Ken Cochran's comments recently that the county only owned the 'brick and mortar,' and CGHC owns the business.”

Hospital Management Agreement

The agreement's effective date was Feb. 20, 2004, and is good for ten years.

The second paragraph of the county and hospital agreement reads: “Cibola General Hospital is a general acute care hospital owned by the County located in the City of Grants, County of Cibola, New Mexico.”

    Article I, 1.4, of the agreement states: “‘Hospital’ means the real estate and improvements of CGH owned by the County including the Hospital building and surrounding parking areas, driveways, and other improvements, appurtenances, fixtures, furniture and other tangible personal property used in connection with, or incorporated into or affixed to any part of the Hospital building as of the Effective Date.”

    Article I, 1.5, states: “‘Hospital Operations’ means all health care, administrative and related or ancillary activities conducted as of the Effective Date.”

    Article III, 3.1, states: “Management of Hospital. The County hereby engages CGHC to manage the Hospital, including the provision of all services necessary or required to provide for the day to day operation of the Hospital, and CGHC hereby accepts the management responsibility for the Hospital for the Term.”

Chairman Michael said on Sept. 24 that he has other issues with CGHC such as an architectural contract not approved by the commission and open meetings policy. However, he said his top priority now is the statement from the hospital board.

    The hospital board was expected to meet last evening. The county commission is to meet in executive session Sept. 29, at 2 p.m.

    " Is Eddie Michael the only commissioner in Cibola County? Sounds like all the others are riding passenger and allowing him and Scott Vinson to call all the shots. Why aren't the other commissioners standing up to them and doing what they were elected to do such as represent the best interests of Cibola County residents? During election time we always hear about the great job that the commissioners are going to do and how they are going to be better than the commission before them. Now that we need you the most, where are you? What are you waiting for and how much longer can you allow Cibola County to be ran by this sorry excuse for a County Manager? It is only getting worse day by day. Come on commissioners we are waiting for something positive to be done. Stand up and represent us like you promised, after all, you are Cibola County residents unlike Mr. Vinson. "

    " It seems everything that is going wrong in this County is a result of Mr. Scott Vinson. He is a man out for himself and has no self-control over his mouth. My child was in the Compliance Program which was a good program as of 2 months ago. He has since forced the employees to quit. He has handed the program to Rhetta King and her Staff who are far from qualified to run this program. I ask how can she supervise Offenders in the County and also hire them at her place of business. Not to mention she is supervising her own daughter. Have any of you County Commissioners talked with the employees that left?? I guess it's none of your concern seems like all of you are out for yourselves as well. You brought Mr. Scott Vinson here so he is your problem. Commissioner Gallegos you said in a meeting he wasnt your choice so stand up and do something about it before he tears up this whole County just like he did in Luna County!!! "

    " It has become apparent that Scott Vinson has a lengthly history of being unethical. The mailbox at the County for Scott Vinson is overflowing and the post it notes left on his door are just other indications that he simply continues to ignore the citizens of Cibola County and their needs instead of his own. He continues to make fires and, instead of putting them out, he is throwing gasoline on them. His lack of professionalism,language that would make a sailor cringe,inability to make it to the office, and the rude and inappropraite manner in which he speaks to his employees, are just the tip of the iceberg for reasons that he should not be Cibola County Manager. As a Cibola County resident, I would like to know if he gets paid for all of his absences? Has anyone ever thought of drug testing this man? With this type of behavior, it might be a good idea. It is county policy for all other county employees...why not him? "

    " Well, it looks like Scott Vinson is stirring up a hornets nest in Cibola County. We endured it for 16 years here in Luna County. Our new county manager has had his hands full correcting all the "restructuring" done by Scott. Oh, by the way Luna County is calling its first ever Grand Jury. Becky Allen Gilmore, who resigned as a Luna County Commissioner, is being indicted on the misuse of public money and embezzlement. Ms. Gilmore used to be very close friends with Scott Vinson, until she got indicted. She claims Scott Vinson approved the land deal that she is accused of. Ms. Gilmore is a real estate agent here in Deming that was involved in Luna County buying a theater property to convert to a health clinic. Like I said before, don't take my word, read it yourself on the internet. "

    Because the contracts exist, are on file at the county, and they are not required by that contract to issue any additional statements, only to abide by that contract. Vinson has no business wanting to alter the contracts.

    Mark my words: He will try to sell the hospital, then he will try to sell the jail. If anyone remembers the problems that cropped up after 4C's was sold to CCA... it speaks for itself why no one should even consider selling our new jail to a private entity.

    And just whose pockets are going to be lined by all this? Follow the money, folks. "

    " The Deming newspaper on Feb. 18, 2009 printed that "County Manager Scott Vinson's contract has been terminated." Vinson received a severance pkg. of 18 months salary, health insurance, and payments to his retirement fund. It quoted Mr. Vinson, "I'm ready to retire." The paper said his plans were to remain in Deming, enjoying time with his grandchildren, riding his motorcyle & tending to property. So, what is he doing here?? I think his agenda is to cause controversy, get dismissed, collect a hefty severance,& laugh all the way to the bank or on to ravage another county. As to "Cibola Resident" who thinks Vinson is doing a great job--get out & talk to current & former county employees. You'll get a real perspective of what we're dealing with. Something is very fishy here in Cibola County. "

    " It doesn't take a blind man to figure out that Mr. Vinson is not interested in the best interests of Cibola County. There were local applicants for the County Manager position who were very qualified. What's wrong with our commisioners? They simply sent out the message that a foul mouthed, self-centered crook from Luna County was more qualified. It's apparent that the commission is back to old dirty politics again with the Micheals. Luna County had to buy Mr.Vinson out of his contract in order to get rid of him and his unprofessional ways. Looks like Mr. Vinson is looking for the easy way out again. If he was interested in the best interest of Cibola County he would go to work once in awhile. Mr. Vinson wants to be bought out of his contract again. Face it commissioners, you made a BIG mistake by hiring this guy. Who is more important...the citizens of Cibola County and their best interest or Edward Micheal and his foul mouthed sidekick (Mr. Vinson) who is merely a transplant from another County with an evil agenda. "

    " I guess you haven't been to an emergency room in Albuquerque? I spent ten (10) hours WAITING to be seen. I could've been seen in Grants, gone back to Alb. and gone to bed by the time I was seen after ten hours in Alb. And, I wasn't even seen by a doctor--it was a physician's assistant. Here in Grants, at least you get to see a doctor without waiting 10 hours. Is this what you want for your hospital? Yes, there are two sides to every story--and so far I haven't heard the other side! Maybe they should speak up and stop the controversy. "

Regardless of who owns what, I do not want the "hospital" to be sold, be it brick and board and/or the business. When sold to private interests, medical costs will increase, perhaps soar, and will only cause more financial hardship for the people of Grants. Money has to be found to pay for the purchase and there's only one source -- the patients! Patients are responsible for the whole hospital bill and have to pay any amount their insurance won't cover. Selling the "hospital" for roads or anything else is a *very* bad idea. Better/new roads is a 1-time improvement while increased medical costs (as related the sale) will continue on *forever*. And if the "hospital" goes into private hands, what's to stop the new owner from selling it again some time later? Think of the turmoil private ownership will cause. In the interest of stability, publicly-owned hospitals should remain in public hands and must never be sold. I can live with bad roads but I cannot live with higher medical costs forever. Can you? If we want better roads, we can do what other towns do which is to raise money by offering a bond. A municipal bond will get us the money for roads and we'll pay off the bond by raising local taxes for the next X years. Once it's paid off, that tax will vanish with a sunset clause. A bond referendum will spell out what the money will be used for (can't use it for something else) and Grants residents get to vote on it. If it passes, we get better roads; if it doesn't, we won't. This is *our* town -- we should have a direct say in whether we want the "hospital" to be sold for/or better roads or anything else. Nothing comes for free -- if we want better roads, we have to pay for them and we can pay through higher taxes for a *fixed* number of years or through higher medical bills *forever* (if the "hospital" is to be sold for better roads). Higher taxes for a fixed number of years is a better choice IMO. I don't want higher medical bills forever. And don't believe any promises either. Promises will be broken when there's money to be made. BTW, I've searched the net for Vinson's performance at Luna County as suggested by "Deming resident with Grants ties" and the little I've read isn't good. "

    " I think that Mr. Vinson and Commissioner Michael are doing a great job. and for those people out there who want to criticize the job that Mr. Vinson and Edward are doing i'd like to remind them that there are two sides to every story and that pleasing everyone in a County is impossible. Maybe these people should go to the local emergency room and see how many hours you have to wait for treatment, and when you do get is see what kind of service you get. Then make up your mind about how great our hospital is currently being run and managed by Mr. Cochran. "

Also being that I moved here from a northern state and retired with medical insurance I was overcharged so they could add to the poor peoples fund that can't pay. I was in the hospital in Jan. and am still receiving bills. I was in the hospital 3 hours and the cost was $9,000. I have to (pay) $2,500 of the bill. My insurance wouldn't pay because they overcharged.Is this what we want here in Cibola County??? I think you just talked to Mr. Vinson's good ole' boys there! "

Was it just the physical building and grounds or did it include the business as well? If the business was to be excluded, I'd expect to see an exclusion clause in the purchase agreement excluding it from the sale. If no such clause exists, the county commissioners may be right in saying the county bought the physical building and grounds and the business. One for the courts? "

    " It looks like Scott Vinson is up to his old tricks he pulled here in Luna County. Mr. Vinson took over control of our hospital here in Deming and later sold it. Looks like history is going to repeat itself. Don't take my word, find out for yourself. Type SCOTT VINSON in any search engine and find out what really took place here in Luna County for the last 16 years. Pay particular attention to comments made by citizens below the news articles and form your own opinion. I've also noticed recent early retirements and resignations by Cibola County employees. This is no accident. This is how Mr. Vinson runs county management. All non-elected County employees have a target on their backs. I hope that the citizens of Cibola County go to County Board meetings to be more informed, but leave your young children at home. Mr. Vinson tends to use unprofessional language that would make the late great George Carlin blush. "

    Cibola County residence should know that Mr. Vinson was the puppet for the sale of the Deming Hospital put it was Toby Michael, Commissioner Eddie Michael's Uncle who was the master mind.
    Your hospitals next! It was also the Michael's the were behind the sorry renovation of the the hospital the first time. Mr. Vinson also has a bad habit of yelling, cursing and belittling county employees. How professional is that! Wake up Cibola County Citizens You Better Start Protecting Your Interest!     " It sounds like it is time to start looking for a new commission again. Perhaps the transparency that commissioner Michael is looking for needs to start with our commission. Perhaps they need to tell the citizens of Cibola County about their recent midterm raises. This hospital controversy looks like a money grab by the county commission at the expense of healthcare in Cibola County. "
